Many people want to try to avoid probate because they have heard that it is time consuming and expensive. Although simple probates can take as little as six months and are not too expensive, even when handled by an Attorney, in some cases, it is advisable to take certain steps to avoid probate. Such actions must occur prior to death. Some of the following are common actions taken prior to death to avoid probate:

1. Holding real property as “Joint Tenancy with Right of Survivorship.”

2. Recording a Beneficiary Deed for your real property

3. Setting up joint accounts or pay on death accounts.

4. Listing beneficiaries on life insurance, retirement accounts, etc.
